TShield Academy Terms of Use

These Terms form an agreement between you and Lusquan B.V., Florastraat 59, 4613 CV Bergen op Zoom, Noord-Brabant, The Netherlands (“Lusquan”, “we”, “us”). KvK: 76491684. VAT: NL860643335B01.

1. Scope and acceptance

These Terms govern access to the TShield Academy, including courses, videos, audio, documents, laboratories, cyber-range simulations, assessments, examinations, certification pathways, events and related services. By creating an account or using the Academy, you agree to these Terms and acknowledge the Academy Privacy Policy. If an organisation provides your account, both you and that organisation may have responsibilities under these Terms.

2. Eligibility and younger learners

The Academy is not restricted to users aged 18 or older. You must nevertheless have the legal capacity required in your country to accept these Terms. Where law requires permission from a parent or legal guardian, you may register or participate only with that permission. A parent, guardian, school or sponsoring organisation must supervise younger learners where appropriate. Lusquan may request reasonable proof of authorisation or restrict features for younger learners.

3. Accounts and security

• Provide accurate, current information and maintain one personal account unless Lusquan authorises otherwise.
• Keep credentials confidential and notify legal@lusquan.com promptly about suspected unauthorised use.
• Do not share accounts, impersonate others, bypass access controls or allow another person to complete assessed work for you.
• We may require email verification, multifactor authentication or identity checks for examinations and credentials.

4. Academy services

Course descriptions, availability, prerequisites, schedules and assessment rules may change as TShield develops. Beta laboratories and simulations may be incomplete or temporarily unavailable. Training material is educational and does not replace professional cybersecurity, legal, regulatory or incident-response advice.

5. Acceptable use and cyber range

You may use laboratories, synthetic telemetry, simulated appliances and security tooling only for authorised educational activity inside the assigned environment. You must not target real systems, other users, Lusquan infrastructure or third parties; introduce malware outside an expressly isolated exercise; scan or attack unauthorised assets; evade monitoring; extract secrets; disrupt service; or use acquired knowledge unlawfully. Cyber-range resources may be monitored and recorded for safety, integrity and assessment.

6. Learning integrity, examinations and certification

You must complete assessed work honestly and comply with examination instructions. Prohibited conduct includes unauthorised assistance, answer sharing, use of another person, falsifying identity or evidence, extracting examination content, and using unapproved automation or AI tools. Lusquan may investigate, invalidate results, revoke credentials, require reassessment or suspend access. Certification is awarded only when all published requirements are met and may expire or require continuing education.

7. Intellectual property

The Academy, TShield materials, software, interfaces, laboratories, question banks, graphics, trademarks and documentation are owned by or licensed to Lusquan and protected by intellectual-property law. Subject to these Terms, Lusquan grants you a limited, personal, non-exclusive, non-transferable, revocable right to use assigned content for learning. You may not sell, sublicense, publish, scrape, systematically download, reproduce, reverse engineer or create competing training material from protected Academy content except where mandatory law permits.

8. User submissions and feedback

You retain rights in original material you submit. You grant Lusquan the rights reasonably necessary to host, process, assess and display it for Academy operation. Do not submit confidential third-party data, personal data you lack authority to disclose, malicious code or unlawful content. Feedback may be used without restriction or payment, without identifying you publicly unless agreed.

9. Fees and organisational access

Some services may later require payment or an organisational licence. Applicable prices, taxes, renewal, cancellation and refund conditions will be disclosed before purchase and may be supplemented by an order form. An organisation may assign seats and receive permitted progress or credential information about sponsored learners.

10. Availability and changes

We aim to provide a secure, reliable service but do not promise uninterrupted or error-free availability. Maintenance, security events, capacity controls and circumstances beyond reasonable control may affect access. We may improve, replace or discontinue features and will provide reasonable notice where a material change adversely affects paid access.

11. Suspension and termination

You may stop using the Academy and request account closure. Lusquan may restrict or terminate access for breach, security risk, non-payment, legal requirements, examination misconduct or material harm. Where appropriate, we will give notice and an opportunity to respond. Provisions intended to survive—including intellectual property, liability, evidence and dispute provisions—continue after termination.

12. Disclaimers and liability

To the maximum extent permitted by law, Academy content is provided on an “as available” basis. Lusquan does not guarantee that completing training prevents incidents, ensures employment, satisfies every regulatory duty or produces a particular operational result. Nothing excludes liability that cannot legally be excluded, including liability for intent or deliberate recklessness, or mandatory consumer rights. Subject to mandatory law, Lusquan is not liable for indirect or consequential losses, loss of profit, data or opportunity arising from unauthorised or improper use.

13. Governing law and disputes

These Terms are governed by Dutch law. Courts competent for Bergen op Zoom, The Netherlands have jurisdiction, except where mandatory consumer law permits proceedings elsewhere. Please first contact legal@lusquan.com so we can attempt to resolve the matter.

14. Changes to these Terms

We may update these Terms for legal, security, operational or product reasons. The effective date and version will be shown above. Material changes may be communicated through the Academy or email and may require renewed acceptance.
